Please read these Terms and Conditions carefully before booking a tour with Best Phuket Guide ("we", "us", "our"). By making a booking you confirm that you have read, understood and agree to these terms.
1. Booking Conditions
1.1 Confirmation. Your booking is confirmed once you receive a booking confirmation email with a unique booking reference. For Stripe payments, confirmation is immediate upon successful payment. For bank transfers, confirmation is issued once we have verified receipt of funds. For cash bookings, confirmation is sent immediately but the tour slot is held provisionally until payment is collected.
1.2 Accuracy of Information. You are responsible for ensuring all booking details (tour date, number of guests, contact details) are correct at the time of booking. Please review your confirmation email and contact us promptly if there are any errors.
1.3 Modifications. Requests to change the tour date or guest numbers are subject to availability and must be made at least 48 hours before the original departure time. Modifications are processed at no additional charge unless a price difference applies.
1.4 Group Bookings. For groups of 10 or more we recommend contacting us directly before booking online to discuss group rates, logistics and availability.
2. Cancellation & Refund Policy
2.1 Guest Cancellations. Cancellations made more than 24 hours before the scheduled departure time are eligible for a full refund. Cancellations made within 24 hours of the tour departure are non-refundable. For private speedboat charters, the cancellation window is 48 hours before departure.
2.2 Refund Processing. Approved refunds are returned to the original payment method within 5–10 business days for card payments and 3–5 business days for bank transfers. We do not charge any cancellation or processing fee for cancellations made within the eligible window.
2.3 No-shows. Guests who do not attend the tour without prior cancellation notice are not entitled to a refund.
2.4 Weather & Operator Cancellations. If we cancel a tour due to unsafe weather conditions, Thai government restrictions, or insufficient participant numbers, you will receive a full refund or the option to reschedule at no additional cost. We will notify you as early as possible.
3. Payment Terms
3.1 Accepted Methods. We accept credit cards, debit cards (via Stripe), bank transfer, and cash. Payment method availability may vary by tour type.
3.2 Currency. Tour prices are listed in Thai Baht (THB). If you choose to pay in a foreign currency, the exchange rate applied is indicative and based on market rates updated every two hours. Your bank or card issuer may apply their own exchange rate and/or foreign transaction fees for which we are not responsible.
3.3 Deposit Bookings. For selected tours, a partial deposit option may be available. In this case, the deposit is charged immediately and the remaining balance is payable to your guide on the day of the tour before boarding. Failure to pay the remaining balance will result in the booking being cancelled without refund of the deposit.
3.4 Bank Transfer. Bank transfer bookings must be paid within 24 hours of booking. Bookings not paid within this window will be automatically cancelled. Please include your booking reference in the transfer note.
4. Tour Operations
4.1 Departure Times. Please be at the designated meeting point or pick-up location at least 15 minutes before the stated departure time. We cannot hold the boat for late arrivals and no refund will be given for missed departures due to lateness.
4.2 Weather. Our tours operate in all but the most severe weather conditions. The final decision to operate rests with the captain based on sea state, wind and forecast. If a tour is curtailed during operation due to sudden weather deterioration, a partial refund may be offered at our discretion.
4.3 Minimum Participants. Some group tours require a minimum number of participants to operate. If the minimum is not reached, we will offer you a full refund or the option to transfer to an alternative date. We will notify you at least 24 hours in advance.
4.4 Itinerary Changes. Itineraries are subject to change without notice due to weather, sea conditions, national park closures, or other circumstances beyond our control. Alternative stops of comparable value may be substituted.
4.5 National Park Fees. Where tours visit Thai national marine parks, entrance fees (typically ฿400 per adult, ฿200 per child) are payable directly at the park and are not included in the tour price unless explicitly stated.
5. Liability
5.1 Insurance. All tours include passenger accident insurance. We strongly recommend all guests purchase comprehensive travel insurance before travel, covering medical emergencies, trip cancellation, and personal belongings.
5.2 Personal Belongings. We are not liable for any loss, theft or damage to personal belongings. Valuables should be left in a secure location. We provide a dry bag or storage area on board but cannot guarantee the safety of your property.
5.3 Health & Medical Conditions. Guests are responsible for disclosing any medical conditions that may affect their participation. We recommend that guests with heart conditions, back problems, or who are pregnant consult their doctor before booking. We reserve the right to refuse participation if we reasonably believe a guest's health may put themselves or others at risk.
5.4 Guest Conduct. We reserve the right to remove any guest from a tour at any time without refund if their behaviour is unsafe, disruptive, or illegal. Alcohol consumption is not permitted until the return journey.
5.5 Limitation of Liability. To the maximum extent permitted by Thai law, our liability for any claim arising from a booking is limited to the amount paid for the tour. We are not liable for indirect, consequential or special damages.
6. Intellectual Property
All content on the Best Phuket Guide website (including text, photography, video, tour descriptions, pricing and logos) is the property of Best Phuket Guide and is protected by copyright. You may not reproduce, distribute, or commercially use any content without our prior written consent.
7. Privacy
Our collection and use of your personal data is governed by our Privacy Policy. By making a booking you consent to the processing of your personal data as described in that policy.
8. Governing Law
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Phuket Province, Thailand.
